Five Questions To Ask Your Personal Injury Lawyer

1. Who will be handling my case?

Many law firms have multiple lawyers on one case, for many of their cases. Often times, the actual representation for personal injury cases will be done with less experienced associates with the experienced, senior partners only in the initial meetings. Find out who in the firm will be working with you directly, as they will become your main point of contact. Ask who will be supervising the case. Get to know the firm before you make a commitment to them. If you are not comfortable with the way they are handling the meeting now, then you may never be comfortable. 2. What are your fees? 

Most personal injury law firms handle cases on a contingency fee basis. A contingency fee basis simply means that you don’t have to pay a fee unless we recover monetary damages in your lawsuit. The fee that a personal injury lawyer takes is usually a percentage of the awarded damages- usually between 25 percent and 40 percent, depending on the case and qualifications of the attorney.

If you lose the case, some personal injury lawyers do charge for any case related costs they have incurred. These are called “out of pocket” expenses. Be sure to ask your lawyer before you retain them what any out of pocket expenses would be for you in the event that your lawsuit is unsuccessful.

3. Have you tried a personal injury case like mine before?

It’s important to remember that just because your potential lawyer specializes in personal injury law that doesn’t mean that they have handled a case like yours before. You should ask every potential lawyer or law firm about their experience and results. If you were injured in a motorcycle accident, you may not want to hire an attorney whose expertise is in workers compensation cases. Similarly, you may not want to hire a law firm who specializes in medical malpractice if you were involved in a car accident. Remember, you will be working closely with this lawyer and their team while your case is being handled.

4. What is my role as a victim in the lawsuit?

Before you decide which lawyer or law firm you want to work with on your personal injury case, make sure you understand your role in the lawsuit. What does your lawyer expect of you? Some people like to be very involved in their case by attending meetings and depositions. Others would rather their personal injury lawyer to handle everything. And then there are people simply cannot be as involved due to their injuries. It’s important to have all parties in agreement of what their expectations are of each other going in. That way, you know what to expect and so does your lawyer.

5. Do you have any past clients I can talk to?

Referrals are always important for any business- that’s why they are so paramount to the way things are handled today. You wouldn’t go to a restaurant that had terrible reviews, would you? A lawyer is no different. Always ask if your lawyer has any referrals of any past clients they have had success with. They should have at least one former client who can attest to their skills. You will know what to expect from them going in. So you will be confident your case is being handled the way you deserve it to be.
